Our partner María José Zegers Quiroga was consulted by Diario Financiero on the regulation of water and water use rights approved by the Plenary of the Constitutional Council. He emphasizes that the council’s proposal: “It has a wording similar to that contained in the current Water Code, in that it states that waters are national goods for public use, which implies that their dominion and use belongs to all the inhabitants of the nation”. He adds that the proposal on water use rights “is very brief and general, leaving the requirements and limitations to the constitution, transfer and exercise of such rights (for example, that they cannot be constituted on glaciers) to the law,” he said.
